Case Brief Summary & Legal Analysis

General Brief
3 min read

tl;dr: A woman sought to enforce an “employment contract” against her deceased lover’s estate. The court invalidated the contract, finding its true purpose was a sexual relationship, which constitutes an unlawful cause, and that its terms were illusory.

Legal Significance: A contract, regardless of its form, is unenforceable if its cause is a meretricious relationship, as this violates public policy. Additionally, an obligation dependent on the whim of the parties is a nullity due to a purely potestative condition.

Case Facts & Court Holding

Key Facts & Case Background

Dr. J.C. Wilmer Rhodes, Sr., an 89-year-old widower, met Judy Harrison, who was over 30 years his junior, through an online dating service. They developed a sexual relationship, and after extensive negotiations that mixed financial terms with sexual banter, Harrison moved to be with Rhodes. On February 12, 2003, 42 days before his death, they executed a document titled “Employment Contract.” The contract stipulated that Harrison would receive a substantial sum from Rhodes’s estate upon his death or incapacity “for services rendered,” but did not specify the nature of those services. A key provision allowed either party to terminate the agreement at any time for any reason, in which case Harrison would receive nothing. Harrison provided some caretaking services, such as cooking and driving, but primarily lived with Rhodes as his intimate partner. After Rhodes died, his son, as executor of the estate, challenged the contract’s validity. The trial court found Harrison was not a credible witness and that the contract’s true purpose was to secure sexual services, rendering it an absolute nullity.

Court Holding & Legal Precedent

Issue: Is a purported employment contract enforceable when extrinsic evidence indicates its primary cause is a meretricious relationship and its fulfillment is dependent on a purely potestative condition allowing either party to terminate at will?

No. The contract is unenforceable. The court affirmed the trial court’s judgment, Lorem ipsum dolor sit amet, consectetur adipiscing elit, sed do eiusmod tempor incididunt ut labore et dolore magna aliqua.
