Gloria Swanson, an African-American woman, applied for a home-equity loan from Citibank. In her application, she estimated her home’s value at $270,000. Citibank conditionally approved a $50,000 loan, pending an appraisal. Citibank then hired Andre Lanier of PCI Appraisal Services, who appraised the home at only $170,000. Based on this low appraisal, Citibank denied the loan. Two months later, Swanson obtained a separate appraisal valuing the home at $240,000. Swanson filed suit, alleging that Citibank, Lanier, and PCI conspired to intentionally undervalue her home because of her race, thereby creating a pretext to deny her the loan in violation of the Fair Housing Act. She also brought a common-law fraud claim, alleging Citibank falsely advertised its intent to make loans with federal funds.
