Appellant Billy J. Taylor, a male, was convicted of aggravated kidnaping in Louisiana. At the time, Louisiana’s constitution and statutes required that a woman could not be selected for jury service unless she had previously filed a written declaration of her desire to serve. This ‘opt-in’ system resulted in a significant underrepresentation of women on jury lists. It was stipulated that women constituted 53% of the persons eligible for jury service in the relevant judicial district, but no more than 10% of the persons on the jury wheel were women. The venire of 175 persons from which Taylor’s petit jury was to be selected contained no women. Taylor moved to quash the venire, arguing that the systematic exclusion of women deprived him of his Sixth and Fourteenth Amendment right to an impartial jury drawn from a representative segment of the community. The Louisiana Supreme Court upheld the conviction, finding the state’s jury selection system constitutional.
