Plaintiffs, the Teters, purchased a home listed by defendant Old Colony Company. During an inspection, Mr. Teter expressed concern about a crack in a backyard retaining wall. Old Colony’s agent agreed to hire an engineer to assess the property’s structural soundness. The agent retained defendant Kelley, Gidley, an engineering firm. A Kelley, Gidley engineer inspected the property and issued a written report concluding the retaining wall was “structurally sound” and “should be no cause for concern.” The agent informed the Teters that the report was positive, and they received a copy at closing. Several years later, the retaining wall collapsed due to a landslide, causing substantial property damage. A subsequent investigation revealed that the collapse was caused by a large quantity of uncompacted fill dirt behind the wall, a latent defect. The Teters sued Old Colony and Kelley, Gidley for negligence. A jury returned a verdict for the Teters, and both defendants appealed.
