Case Brief Summary & Legal Analysis

General Brief
4 min read

tl;dr: A wife sued for child support and maintenance after a two-month marriage, arguing her husband’s pre-marital promises created a contract. The court rejected her claims, finding no valid consideration for a contract and no detrimental reliance to support a promissory estoppel claim.

Legal Significance: Promises of support made after an agreement to marry do not form a binding contract. For promissory estoppel to apply in a family law context, a party must prove their reliance on a promise resulted in a tangible detriment, not merely a change in circumstances.

Case Facts & Court Holding

Key Facts & Case Background

A Russian woman (“Wife”) met an American man (“Husband”) online. Husband visited Russia and proposed marriage, which Wife accepted because she loved him. After her acceptance, Husband sent emails and filed immigration Affidavits of Support promising to support Wife and her daughters. Relying on these subsequent communications, Wife sold her assets in Russia, sent the proceeds to Husband, and moved with her daughters to the United States. The parties married, but the relationship quickly deteriorated, and they separated after only two months when Wife and her daughters left the home following a social services investigation. Husband filed for dissolution. Wife counter-petitioned, seeking child support for her daughters and spousal maintenance. She argued Husband’s promises created an express contract or, alternatively, that he should be estopped from denying the support obligation due to her detrimental reliance. The trial court found no contract, as the promises were made after the agreement to marry, and no detrimental reliance, as Wife’s life was not made worse by moving to the U.S.
