To maintain its sailing schedule, the owner’s shore agents began rapidly discharging cargo from all five hatches while simultaneously loading coal. This process made the vessel top-heavy and unstable. After discharging most of its cargo, the ship developed a severe list, then rolled suddenly to port, which dislodged a coal port cover. The master’s attempts to correct the list by shifting cargo and adjusting coaling operations failed. The ship rolled to port again, submerging the now-open coal port. Water flooded the vessel, causing it to sink at the pier and damage the remaining cargo. The lower courts found the sinking was caused by the imprudent and hurried manner of unloading, which raised the ship’s center of gravity to a dangerous level.
