Plaintiff Nelson Thomas was injured when his motorcycle collided with a cow owned by the defendants, the Stenbergs. The collision occurred on a paved, private road that crossed the defendants’ 450-acre cattle ranch. The road was a private easement owned by plaintiff’s aunt and another family, providing access to their landlocked homes. The defendants owned the underlying land (the servient tenement) and allowed their Angus cattle to graze freely in the pasture bisected by the road. Plaintiff was a frequent visitor who had traveled the road thousands of times and was aware of the cattle’s presence. The cow that charged him was pregnant. Plaintiff presented no evidence that this specific cow had previously exhibited dangerous propensities, nor had any similar vehicular accidents occurred on the easement in the past 40 years. The defendants had previously offered to allow the easement owners to construct a fence if they contributed financially, but no fence was ever built. At the close of plaintiff’s case, the trial court granted defendants’ motion for nonsuit, finding they owed no legal duty to the plaintiff.
