Rebecca Thomson (Appellant) contracted to purchase a home, with the sale conditioned upon a satisfactory furnace inspection. The seller’s real estate agent, Erma McGinnis (Appellee), agreed to arrange the inspection. McGinnis retained David Stephens, who was already at the property for a termite inspection, to also inspect the furnace. Stephens’s inspection consisted of merely listening to the furnace run. McGinnis then provided Stephens with a “Heating Certification” form, which he signed, attesting that the furnace was in proper working condition. Relying on this certification, Thomson purchased the home. Shortly after, she discovered the furnace was inoperable, dangerous, and lacked a safety shut-off switch. Stephens later admitted to Thomson that he was not qualified to inspect furnaces and had signed the certification only at McGinnis’s direction. Thomson sued McGinnis and her brokerage for negligence and fraud. The trial court granted summary judgment for the Appellees, finding they had no duty regarding the inspection. Thomson appealed.
