Thurston Enterprises, Inc. (“Thurston”) purchased a parcel from Lawrence Baldi (“Baldi”) for marina development. The deed included an express fifty-foot easement for access across Baldi’s adjoining drive-in movie theater property. The easement was subject to a limitation that Thurston’s use “shall not interfere with the Grantor’s use of the property.” At the time of the grant, a low-hanging marquee and a ticket booth were located on the right-of-way, and the surface was a light asphalt mix suitable for cars. Thurston began using the easement for heavy, ten-wheel trucks to haul fill, a use the parties had not contemplated. The trucks were too large to pass under the marquee or around the ticket booth without deviating from the specified path. This heavy use destroyed the pavement and rutted the underlying ground, interfering with Baldi’s theater operations. After Baldi blocked the entrance, Thurston sued for an injunction, and Baldi counterclaimed. A master ordered Thurston to repair the damage and upgrade the road to highway specifications, with Baldi contributing one-third of the cost as a “betterment.”
