Appellees (lessors) leased mineral rights to appellants (lessees). The lessees also held leases on surrounding tracts within a common gas reservoir. To maximize recovery and prevent waste, the lessees began recycling operations, which involved extracting wet gas, processing it, and reinjecting dry gas into the reservoir. This process was standard in the field but required unitizing multiple tracts to be profitable. The lessees repeatedly offered the lessors a fair and reasonable opportunity to unitize their tracts and participate in the recycling program on the same basis as other royalty owners. The lessors refused all offers. Consequently, the lessees proceeded with recycling on their other leases, which caused dry gas to migrate and displace the more valuable wet gas under the lessors’ lands. The lessors sued for damages, alleging the lessees breached an implied covenant not to injure their leasehold interest by causing this drainage. It was conceded that drilling additional wells on the lessors’ tracts alone was not economically feasible and that recycling was impossible without unitization.
