Plaintiffs’ minor son was bitten by a Bullmastiff dog owned by a tenant residing in a property leased from the defendant, Wye Electric, Inc. The tenants kept several dogs on the premises. The Turnbows sued Wye Electric, the landlord, under a negligence theory. The lease agreement contained no provisions prohibiting or regulating tenants’ pets. Discovery revealed that while some of Wye Electric’s employees had been to the property and were vaguely aware that a dog was present, they did not know the specific breed of the dog that caused the injury, had never observed any aggressive behavior, and had never received any complaints about the animals. The plaintiffs could not produce any evidence showing that the landlord or its employees possessed actual knowledge of the Bullmastiff’s dangerous nature prior to the incident. The trial court granted summary judgment for Wye Electric.
