C.A. Rinehart’s will placed the residue of his estate in a trust for his daughter, Merle Rinehart Snodgrass. The trust provided that she would receive the entire corpus upon reaching age 32. However, a condition subsequent stipulated that if she married a man of the Catholic faith or became a member of the Catholic church before her 32nd birthday, her interest in the trust would be forfeited. In the event of forfeiture, the trust assets were to be distributed to other named relatives. The testator died in 1942. In 1944, Ms. Snodgrass, with full knowledge of the will’s provision, married a Catholic man. She did not, however, join the Catholic church herself. The trustee bank brought a declaratory judgment action to determine the validity of the condition. The trial court found the condition valid and that Ms. Snodgrass had forfeited her inheritance. Ms. Snodgrass appealed, arguing the condition was void as a violation of public policy.
