Appellants Joshua Burton and Quinton Carr, who are cousins, were charged with conspiracy and attempted bank robbery. Two masked men attempted to rob a bank, threatening employees with guns before fleeing in a blue car driven by a third person. The car, found abandoned nearby, belonged to Carr. The next day, Carr reported the car stolen. The government’s case was entirely circumstantial. Evidence against Joshua Burton included receipts found in his room for grey sweat suits and a duffel bag, items described as similar to those used by the robbers. An uncle also testified he saw Joshua driving Carr’s car near the bank on the morning of the robbery. Evidence against Carr included the use of his car in the robbery, his subsequent false stolen car report, and testimony that he was driving Joshua’s car on the day of the crime. Another cousin, Wilton Burton, who allegedly entered the bank with Joshua, gave a statement to police implicating the appellants but recanted at trial, claiming coercion.
