A state magistrate issued a search warrant for Tyrone Christian’s residence based on an affidavit from Officer Thomas Bush. The affidavit contained several key assertions: (1) Christian had four prior drug convictions, ranging from 4 to 19 years old; (2) a “credible and reliable informant” had conducted a single controlled purchase of drugs from Christian at the residence eight months prior to the warrant application; (3) within the last four months, “several” unidentified subjects of unknown reliability told police they had purchased drugs from Christian at the residence; and (4) on the day the warrant was sought, officers conducting surveillance saw a man, Rueben Thomas, “walk away from the area” of the residence. Thomas, who had no known connection to Christian, was later stopped in his vehicle and found to possess heroin. The affidavit noted that Thomas’s denial of being at the residence was “contrary to the observations of the law enforcement officers,” but did not state that officers saw him enter, leave, or on the property itself. A search of Christian’s home pursuant to the warrant uncovered drugs and firearms. Christian moved to suppress the evidence, arguing the warrant lacked probable cause.
