Defendant Robert Haney and his friend, co-defendant Tony Francis, were inmates at a federal penitentiary experiencing severe racial tension. Francis was credibly threatened by other inmates who mistakenly believed he was an Aryan Brotherhood leader after a false report on “America’s Most Wanted.” The threats indicated Francis would be a primary target in an impending race war. Believing Francis’s life was in imminent danger, Haney helped him gather escape paraphernalia. Haney himself was not threatened. Both men testified that seeking help from prison authorities, such as requesting protective custody, was not a reasonable alternative because it would label Francis a “snitch” and expose him to even greater danger. Haney and Francis were caught with the paraphernalia before any escape occurred. At trial, the district court refused to provide a jury instruction on the defense of duress for Haney, reasoning the threat was not directed at him. The jury, which did receive a duress instruction for Francis, acquitted him of attempted escape on that basis but convicted both men of possessing escape paraphernalia.
