Defendant Cheryl Hunte accompanied her boyfriend, Joseph Richards, a known drug dealer, on a cross-country trip to acquire marijuana. Richards organized the trip, supplied the vehicles, and recruited other co-conspirators. In Tucson, Arizona, a large quantity of marijuana was loaded into the group’s minivan. Hunte did not handle the marijuana bundles but was present in the house, watching television in another room while the men weighed the drugs. She later closed the window blinds while the group smoked a sample joint she helped roll. Richards paid for all expenses, including a motel room Hunte registered for under her name. On the return trip, Hunte and Richards traveled in a separate “lead” car. After the minivan containing the drugs was stopped by police, Hunte and Richards switched positions so Hunte was driving their car. When subsequently stopped, she lied to police about their travel purpose and their association with the minivan. No fingerprints from Hunte were found on the drug packaging, and she was not promised any proceeds from the drug sale. A jury found her guilty of conspiracy and possession with intent to distribute.
