Case Brief Summary & Legal Analysis

General Brief
3 min read

tl;dr: A man was convicted of being a felon with a gun after his girlfriend’s 911 call was admitted into evidence. The court affirmed, holding the call was an admissible “excited utterance” because her statements about the gun related to the startling event of his domestic battery.

Legal Significance: This case provides a modern application of the excited utterance exception (FRE 803(2)), holding that a statement about a weapon can “relate to” a domestic battery even if not used in the assault. It is also notable for Judge Posner’s influential critique of hearsay exceptions.

Case Facts & Court Holding

Key Facts & Case Background

Sarah Portis called 911 stating that the defendant, Darnell Boyce, had just physically assaulted her. In response to the operator’s questions, Portis confirmed that Boyce had a gun and that she had seen it. Officers responded within minutes and described Portis as emotional. Shortly thereafter, officers saw Boyce outside the residence. Boyce fled on foot. During the chase, an officer witnessed Boyce throw a handgun into a yard. Police recovered a .357 Magnum handgun from the area and found three matching bullets in Boyce’s pocket. At his trial for being a felon in possession of a firearm, Portis did not testify. The government introduced the audio recording of her 911 call into evidence over Boyce’s hearsay objection. The district court admitted the call under the present sense impression and excited utterance exceptions. Boyce was convicted and appealed the evidentiary ruling.
