Appellant, an Army reservist and guard at Abu Ghraib prison, was convicted for her role in detainee abuse incidents in 2003. In one incident, she admitted to placing a hooded detainee on a box, attaching wires to his fingers, and telling him he would be electrocuted if he fell off. She then photographed the scene. In a separate incident, after other soldiers stripped detainees and forced them into a human pyramid, Appellant retrieved her camera, took numerous pictures, wrote “I’m a rapeist [sic]” on a detainee’s thigh, and posed for a photograph smiling and giving a “thumbs up” sign in front of the pyramid. Appellant did not report the abuse, despite having previously written in a letter that such acts were “wrong” and a “form of molestation.” She argued at trial that she lacked the requisite intent for conspiracy, was improperly trained for her duties, and that her actions caused no actual harm to the detainees. The government presented her sworn statements and photographic evidence to support the charges.
