A Kentucky grand jury indicted Nicholas Farris, a U.S. mail carrier, for murder. A state court issued a bench warrant for his arrest. The local sheriff, Kirby, and his posse executed the warrant by boarding the steamboat on which Farris was traveling and arresting him. This action necessarily resulted in a temporary detention of the U.S. mail that Farris was carrying. Subsequently, the United States indicted Kirby and the other members of the posse under a federal act that criminalized “knowingly and wilfully obstruct[ing] or retard[ing] the passage of the mail, or of any driver or carrier.” The defendants asserted that their actions were justified as the lawful execution of a felony arrest warrant. The judges of the circuit court were divided on whether this constituted a valid defense, and they certified the question to the Supreme Court.
