Following the Exxon Valdez oil spill, the State of Washington enacted comprehensive regulations establishing “best achievable protection” (BAP) standards for oil tankers operating in its waters. These regulations covered a wide range of topics, including crew training, English language proficiency, navigation watch procedures, and casualty reporting. The International Association of Independent Tanker Owners (Intertanko) challenged the regulations, arguing they were preempted by a comprehensive federal statutory and regulatory scheme, primarily the Ports and Waterways Safety Act (PWSA), as amended by the Oil Pollution Act of 1990 (OPA). Intertanko contended that the state rules undermined the need for national uniformity in maritime commerce. The United States intervened on behalf of Intertanko. The Ninth Circuit Court of Appeals upheld most of the regulations, reasoning that OPA’s saving clauses had narrowed the preemptive scope of the PWSA as interpreted in Ray v. Atlantic Richfield Co.
