Case Facts & Court Holding

Key Facts & Case Background

Matthew Dowd, an escaped felon, reconnected with his former partner, Danna Johnson. After a week, he violently assaulted and raped her. When she tried to flee, he overpowered her, stating he couldn’t let her go because she would “rat on him.” He forced her into a car and made her drive from Colorado to Montana. During the trip, Dowd controlled the car keys and threatened to kill Johnson’s family if she disobeyed. This began an eight-month period of travel through Montana, Colorado, and Utah, during which Dowd subjected Johnson to a continuous pattern of physical, sexual, and psychological abuse. Dowd argued that Johnson’s travel was voluntary, pointing to several instances where she was left unsupervised, such as when she packed their apartment alone or entered a pawn shop by herself. Johnson testified that she was too afraid for her family’s safety to flee, was physically weakened by the abuse, and believed she could not escape. She was eventually diagnosed with post-traumatic stress disorder. A jury convicted Dowd of violating the federal interstate domestic violence statute, 18 U.S.C. § 2261(a)(2).
