Defendant Yuami Yoshida was convicted of alien smuggling under 8 U.S.C. § 1324. Three Chinese nationals paid a smuggling ring to enter the U.S. On the final leg of their journey from Japan, an escort identified Yoshida to the aliens, instructing them to follow her. Yoshida, without speaking to them, led the aliens through Tokyo’s Narita Airport to the correct gate for a flight to Los Angeles, timing their arrival for final boarding. She sat in the row behind them on the flight. Upon arrival in Los Angeles, an INS inspector discovered Yoshida had concealed two baggage claim checks in her underwear. The checks were issued under the aliases used by two of the aliens on their fraudulent travel documents. Yoshida had no checked luggage of her own. Further investigation revealed that the hotel listed as her destination on her entry form did not exist, and her passport showed a pattern of frequent travel in Southeast Asia. The aliens testified that without Yoshida’s guidance, they would not have known how to find their flight.
