Police officers, holding two arrest warrants for Donald Vale, established surveillance on his residence. They observed Vale exit the house, speak with an individual in a car, re-enter the house, and then emerge again to interact with the driver. Believing they were witnessing a narcotics transaction, the officers approached. Upon seeing the police, Vale retreated toward the house. The officers arrested Vale on the front steps. The other individual, a known narcotics user, appeared to swallow something. After the arrest, the officers conducted a warrantless search of Vale’s house. They first checked to ensure no one else was present. During the search, Vale’s mother and brother arrived. The search of a rear bedroom uncovered a quantity of narcotics, which were subsequently used to convict Vale. The Louisiana Supreme Court upheld the search as being substantially contemporaneous with and in the immediate vicinity of the arrest.
