At approximately 1:30 a.m., plaintiff Laura Vetter, driving alone, stopped her van at a red light. A car driven by Dana Gaither, with defendant Chad Morgan as a passenger, pulled up alongside her. Morgan began screaming threats and obscenities at Vetter, shaking his fist, and making violent gestures. The driver, Gaither, revved the engine and moved the car back and forth. Morgan threatened to remove Vetter from her van and spat on her vehicle. Vetter testified she was “very, very frightened.” When the light turned green, both vehicles moved forward. Vetter alleged that Gaither’s car then veered into her lane. In reaction, Vetter steered sharply to the right, struck the curb, and sustained injuries. Morgan admitted to the conduct but stated his intent was to amuse his friends, not to harm Vetter. The trial court granted summary judgment for Morgan on all claims, including assault, negligence, and intentional infliction of emotional distress (tort of outrage). Gaither settled separately with Vetter.
