The Marion County Prosecutor’s Office (MCPO) leased basement space from Village Commons (Landlord) for offices and evidence storage. The lease required the Landlord to maintain the premises but included a clause stating that in the event of a breach by the Landlord, the MCPO could sue for damages or an injunction but was not entitled to terminate the lease or withhold rent. Beginning in 2001, the premises suffered from numerous, severe water intrusions, including leaks from pipes, HVAC systems, and sewage backups. These events caused property damage, mold growth, and potential health risks. Despite repeated notifications, the Landlord’s attempts at remediation were inadequate and often delayed due to cost concerns. In October 2002, the Landlord advised the MCPO to stop using portions of the premises that were vulnerable to water damage. Following a major water intrusion in January 2003 where water poured from the ceiling, the MCPO vacated the premises and ceased paying rent. The Landlord sued for the remaining rent due under the lease. The trial court found the Landlord had both actually and constructively evicted the MCPO.
