Plaintiff, an invitee, visited the defendant’s funeral home on a rainy night. The parking lot was dimly lit. As she walked up a ramp with a 14% grade, she slipped and fell. The fall occurred precisely where the ramp’s surface changed from a rough, unsealed asphalt to a smooth, sealed surface that was slick when wet. The defendant had applied the sealer 14 months prior, and it extended halfway down the ramp. Plaintiff was unaware of the change in texture, which was not readily visible in the dim light. Defendant’s officers and employees knew the sealed area was slick when wet, had received numerous complaints from other patrons, and had previously spread sand on the area as a remedial measure, though not on the night of the incident. The trial court also admitted testimony about another patron who had fallen on a similar sealed ramp on the property under wet conditions.
