Virtual Works, Inc. registered the domain name vw.net in 1996. At the time of registration, its principals acknowledged that Internet users might confuse the domain with Volkswagen and discussed the possibility of eventually selling the domain to Volkswagen “for a lot of money.” While other domain names incorporating the company’s initials were available (e.g., vwi.net), they chose vw.net. For two years, Virtual Works used the domain for its internet service provider business. In 1998, Virtual Works contacted Volkswagen, offering to sell the domain. The offer included a 24-hour deadline and a threat to sell vw.net to the highest bidder if Volkswagen did not respond. Volkswagen initiated a dispute resolution process, which led to this litigation. Volkswagen counterclaimed under the Anticybersquatting Consumer Protection Act (ACPA), alleging Virtual Works registered the domain with a bad faith intent to profit from Volkswagen’s famous “VW” trademark. The district court granted summary judgment for Volkswagen.
