For two years, Virtual Works used the domain for its internet service provider business. In 1998, Virtual Works contacted Volkswagen, offering to sell the domain. The offer included a 24-hour deadline and a threat to sell vw.net to the highest bidder if Volkswagen did not respond. Volkswagen initiated a dispute resolution process, which led to this litigation.
