Zuleika Weems Felder’s will devised a one-half interest in her gas and sulphur royalty to several of her cousins, who were all individually named in paragraph 3 of the instrument. The will specified that this interest was “to be held by them jointly.” Several of the named cousins predeceased the testatrix. S.S. Weems, one of the surviving cousins named in the bequest, claimed he was entitled to the entire royalty interest as the sole survivor of a class gift. The appellees, Loise A. Felder and the heirs of J.D. Felder (the “Felder group”), were the testatrix’s sole heirs at law. They argued that the bequest was to individuals, not a class, and that the shares of the predeceased cousins lapsed. The lapsed shares, they contended, should pass to them through the laws of descent and distribution, as the will contained a residuary clause. The trial court found in favor of the Felder group, holding that the bequest was not a class gift and that the shares of the predeceased devisees had lapsed.
