Plaintiff Wendell Wenner, a farmer, sued defendant Gulf Oil Corp. for breach of warranty. Wenner had applied Gulf’s herbicide, “Outfox,” to a cornfield in 1974. The following year, he planted spring wheat in the same field. The wheat grown on the 134 acres previously treated with Outfox was damaged and produced a significantly lower yield than the 16 untreated acres in the same field. The Outfox label contained a specific warranty stating, “Outfox will not carryover and injure succeeding crops.” However, the label also included a disclaimer provision attempting to negate all warranties, express or implied, and limit liability to the purchase price. At trial, Wenner argued the herbicide’s active ingredient carried over in the soil, causing the damage. Gulf argued Wenner misapplied the product and that its disclaimer was effective. The jury found for Wenner, and Gulf appealed the denial of its motion for a new trial.
