West Coast Airlines (West Coast) intended to sell several large, sealed metal containers (“cans”) as scrap metal to Junk Traders. Unbeknownst to either party, two of the cans contained valuable aircraft engines. West Coast had no intention of selling the engines, and Junk Traders had no knowledge of their existence, paying only for the scrap metal value of the containers. Sometime later, Junk Traders discovered the engines. Mr. Miner, president of Miner’s Aircraft and an expert in the field, learned of the engines. Aware of their significant value (approx. $3,500 each), that Junk Traders was ignorant of their true nature, and that the required FAA ownership documents were missing, Miner purchased both engines for $125, their scrap metal value. West Coast discovered its error only when Miner contacted it seeking the FAA documents. West Coast brought a replevin action to recover the engines from Miner’s Aircraft.
