Plaintiffs Reginald and Kathy Williams, financially unsophisticated clients, hired defendant Waymon Hunt as a financial advisor. Hunt induced the Williams to invest in “reverse refrigeration units,” requiring a $50,000 down payment on a purported $1 million purchase. The Williams paid the $50,000 to Hunt’s company, STA, with the understanding it was a down payment for the units. The contract stipulated the money would be returned if the purchase could not be fulfilled. Instead of using the funds for the investment, Hunt immediately misappropriated the entire $50,000 for his personal use. He never secured the required financing nor purchased the units. When the Williams inquired about their investment, Hunt repeatedly misrepresented that “things were going fine.” Furthermore, Hunt prepared the Williams’ tax returns, fraudulently claiming deductions and credits related to the non-existent investment. This fraudulent tax preparation exposed the Williams to liability and caused them to incur significant expenses to rectify the situation. Hunt later conceded he owed the money but claimed he could not repay it.
