Plaintiff World of Boxing LLC (WOB) contracted with defendant Don King Productions (King) for King to provide a boxer for a championship bout. King breached the agreement by failing to ensure the boxer’s participation. Because its expectation damages (lost profits) were too speculative to calculate, WOB sought reliance damages. These damages included approximately $1 million in preparatory expenses for transportation, lodging, and promotion, as well as an $800,000 payment made into an escrow account. The parties’ agreement stipulated that $250,000 of the escrow payment was an “immediately payable” and “non-refundable” signing bonus to King. King conceded he owed the remainder of the escrow funds but contested the rest.
