The Board of County Commissioners of Wabaunsee County, Kansas, located in the scenic Flint Hills, considered amending its zoning regulations to address commercial wind farms. After a moratorium and public input, the county adopted a Comprehensive Plan in 2004 that prioritized maintaining the county’s rural character, scenic views, and tourism. Subsequently, the county’s planning commission recommended approving Commercial Wind Energy Conversion Systems (CWECS) as a conditional use. The Board, however, by a 2-1 vote, overrode the commission’s recommendation. It passed Resolution No. 04-18, which amended the county zoning regulations to permit small, non-commercial wind systems but expressly prohibited all CWECS throughout the entire county.
