- William Krieger filed a complaint against Bank of America for violating the Fair Credit Billing Act and the unauthorized-use provision of the Truth in Lending Act.
- Krieger's credit card was used for an unauthorized Western Union money transfer, and despite protesting to Bank of America's representative, he was told that nothing could be done until he received his next billing statement.
- The District Court dismissed Krieger's complaint with prejudice, but the Court of Appeals reversed the decision, stating that Krieger had stated claims for relief under both acts.
- Bank of America's interpretation of the $50 liability limit condition was incorrect, and Krieger had no basis to bring an FCBA claim when he received his August billing statement, which did not list the Western Union charge.
