United States District Court for the Southern District of Alabama - 510 F. Supp. 2d 588
The plaintiffs filed a complaint against Bertha Lacey for copyright infringement, and a Clerk's Entry of Default was entered against her for failing to respond. The court analyzed the plaintiffs' request for entry of default judgment and found that the Complaint states a claim for relief. The Court granted the plaintiffs' Motion for entry of default judgment against Lacey for copyright infringement and awarded the plaintiffs the minimum statutory damages of $6,000 since they have established that Lacey infringed upon their exclusive rights as copyright owners with respect to eight recorded works. The Court also granted the plaintiffs' request for injunctive relief, including a permanent injunction to prevent Lacey from infringing on the plaintiffs' exclusive rights in copyrighted recordings. The relief sought is authorized by copyright law, which allows a court to grant temporary and final injunctions to prevent or restrain copyright infringement.
