Case Brief Summary & Legal Analysis

General Brief
4 min read

tl;dr: Artist Jeff Koons incorporated a fragment of a fashion photograph into a large collage painting. The court ruled this was a protected “transformative” fair use, not copyright infringement, because Koons gave the original image an entirely new meaning and purpose as social commentary.

Legal Significance: This case solidifies the primacy of “transformative use” in the fair use analysis, particularly for appropriation art. It establishes that a secondary work’s commercial nature is significantly less important when the use is highly transformative, providing crucial protection for artists who comment on existing media.

Case Facts & Court Holding

Key Facts & Case Background

Plaintiff Andrea Blanch, a professional photographer, created a photograph titled “Silk Sandals by Gucci” for a feature in Allure magazine. The photograph depicted a woman’s legs and feet, adorned with Gucci sandals, resting on a man’s lap inside an airplane cabin, intended to convey an “erotic sense.” Defendant Jeff Koons, a prominent artist known for appropriation art, was commissioned to create a series of paintings. For his painting “Niagara,” Koons scanned Blanch’s photograph, digitally extracted only the legs and feet, and incorporated them into a large collage. In the painting, Koons inverted the legs, altered their color, and juxtaposed them with images of pastries and a landscape. Koons stated his purpose was to use the image as “raw material” for a commentary on how mass media mediates basic appetites for food and sex. Blanch sued Koons and the commissioning entities for copyright infringement. In her deposition, Blanch admitted that Koons’s use caused no harm to her career or to the market for her photograph. The district court granted summary judgment to the defendants, finding fair use.
