Plaintiff Harriette Blanton sued Womancare, Inc. for medical malpractice. Her attorney, Wesley Harris, represented her. Two days before trial, Harris entered into a stipulation with defense counsel to submit the case to binding arbitration. This was done contrary to Blanton’s express instructions; she had only consented to arbitration if her right to a trial de novo was preserved. The stipulation provided for binding arbitration, capped potential damages at $15,000, and allowed the defendant’s attorney to unilaterally select an arbitrator from a pool of medical malpractice defense attorneys. Upon learning of the agreement three months later, Blanton immediately discharged Harris, retained new counsel, and moved to set aside the stipulation. The trial court denied the motion, reasoning that the decision was a procedural matter within the attorney’s discretion. The subsequent arbitration resulted in an award for the defendants, which was entered as a judgment. Blanton appealed, arguing the stipulation was void for lack of authority.
