The Boy Scouts of America (BSA), a private, non-profit organization, has a stated mission to instill values in young people based on the Scout Oath and Law, which includes being “morally straight” and “clean.” James Dale, a former Eagle Scout, was an assistant scoutmaster whose adult membership was revoked after BSA learned he was an avowed homosexual and a gay rights activist. BSA asserted that homosexual conduct is inconsistent with the values it seeks to instill. Dale filed suit in New Jersey, alleging that his expulsion violated the state’s public accommodations law, which prohibits discrimination on the basis of sexual orientation. The New Jersey Supreme Court held that the state law required BSA to readmit Dale, finding that BSA was a place of public accommodation and that Dale’s inclusion would not significantly affect the organization’s ability to express its views. The U.S. Supreme Court granted certiorari to determine whether applying the New Jersey law in this manner violated BSA’s First Amendment rights.
