Plaintiffs sought a declaratory judgment to be recognized as owners of approximately 60 acres of land in Richland Parish, Louisiana. Defendants were the record title owners. Plaintiffs’ ancestors in title, the Gilley family, began using the disputed property for farming and raising cattle around 1938. Multiple witnesses testified that the Gilleys enclosed the property with a fence by at least 1948 and that this fence remained in place. The Gilleys, and subsequently the Plaintiffs who inherited or purchased the land from the Gilley estate, continuously used the property for farming and pasturage until the litigation commenced. The Plaintiffs tacked their possession onto that of their ancestors to meet the 30-year requirement. In contrast, one of the defendants testified that he had hunted on the property as late as 1965 and saw no fences or farming activity. He also stated that the defendants had leased the property for hunting purposes in the 1980s and beyond. The trial court, after a bench trial, found the testimony of the Plaintiffs’ witnesses to be more credible and ruled in their favor.
