Following the seizure of the U.S. embassy in Tehran in 1979, President Carter, acting under the International Emergency Economic Powers Act (IEEPA), declared a national emergency and froze all Iranian government assets within U.S. jurisdiction. The Treasury Department issued regulations permitting lawsuits against Iran but specified that any resulting pre-judgment attachments were subject to revocable licenses. Petitioner Dames & Moore filed suit for breach of contract and obtained such attachments. To secure the hostages’ release, the U.S. entered into the Algiers Accords, an executive agreement with Iran. The Accords required the U.S. to terminate all legal proceedings against Iran, nullify all attachments, and transfer Iranian assets. Claims were to be resolved by a new Iran-U.S. Claims Tribunal.
