While representing a client in a murder trial, defense attorney James Cheney Mason gave an interview to NBC News. To illustrate the implausibility of the prosecution’s theory, which required his client to make a trip from the Atlanta airport to a hotel in just 28 minutes, Mason stated, “I challenge anybody to show me… I’ll pay them a million dollars if they can do it.” NBC later aired an edited version of the clip on its “Dateline” program. Dustin Kolodziej, a law student, saw the broadcast and interpreted the statement as an offer for a unilateral contract. Without contacting Mason, Kolodziej recorded himself successfully completing the specified travel route in under 28 minutes. He then sent the recording to Mason and demanded payment of one million dollars. Mason refused, stating his comment was not a serious offer. Kolodziej sued for breach of contract. The district court granted summary judgment in favor of Mason, and Kolodziej appealed.
