Defendant, Allouez Mining Co., constructed and operated a large stamp mill that discharged sand into a creek as a necessary part of its mining operations. The year after the mill was built, the complainant, Edwards, purchased downstream land that was being covered by the sand deposits. Evidence indicated that Edwards purchased the property not for personal use or occupation, but as a speculation with the expectation of forcing the defendant to buy the land from him at a highly inflated price. After the defendant declined to purchase the property, Edwards filed a bill in equity seeking an injunction to restrain the defendant from depositing sand on his land. The defendant’s operations, while profitable, were causing a continuous physical invasion of the complainant’s property, which amounted to a nuisance and an effective appropriation of the land.
