Case Facts & Court Holding
Key Facts & Case Background
The plaintiff, Emmett J. Fisher, a Black mathematician with NASA, was a guest at a professional luncheon held at the Brass Ring Club, located within the defendant’s Carrousel Motor Hotel. As Fisher stood in the buffet line with his plate, he was approached by Robert W. Flynn, the club’s manager and an employee of the hotel. Flynn snatched the plate from Fisher’s hand and shouted in a loud and offensive manner that Fisher, being a Negro, could not be served in the club. Fisher was not physically touched, nor did he testify that he feared imminent physical contact. However, he stated that he was highly embarrassed and hurt by Flynn’s conduct, which occurred in the presence of his professional associates. A jury found that Flynn had acted maliciously and awarded Fisher $400 in actual damages for humiliation and $500 in exemplary damages. The trial court entered a judgment notwithstanding the verdict for the defendants, which the appellate court affirmed, on the grounds that no physical contact had occurred.
