The DeKalb County School System (DCSS) had been under a federal desegregation decree since 1969. The initial plan, based on neighborhood schools, temporarily achieved desegregation. Over the next 17 years, significant demographic changes occurred, with a large influx of Black residents into the southern part of the county and corresponding migration of White residents out of that area. This resulted in substantial racial resegregation in the schools, with many schools becoming predominantly Black or predominantly White. In 1986, DCSS moved to be declared “unitary” and have the decree dissolved. The District Court found DCSS had achieved compliance in four areas identified in Green v. School Bd. of New Kent County: student assignments, transportation, physical facilities, and extracurricular activities. It attributed the current racial imbalance in student attendance to private demographic changes, not state action. However, it found vestiges of the prior de jure system remained in faculty assignments and resource allocation. The court decided to relinquish supervision over the compliant areas while retaining it over the non-compliant ones. The Court of Appeals for the Eleventh Circuit reversed, holding that a court must retain full remedial authority until a school system achieves unitary status in all categories simultaneously.
