The New York Legislature granted Robert Livingston and Robert Fulton an exclusive, long-term right to operate steamboats on all waters within the state. This right was subsequently assigned to Aaron Ogden, who operated a ferry between New York City and Elizabethtown, New Jersey. Thomas Gibbons, a competitor, operated two steamboats on the same interstate route. Gibbons’s vessels were licensed under a 1793 act of Congress, “An act for enrolling and licensing ships and vessels to be employed in the coasting trade and fisheries.” Ogden obtained an injunction from the New York Court of Chancery prohibiting Gibbons from operating his boats in New York waters. The highest New York state court affirmed the injunction, upholding the state-granted monopoly. Gibbons appealed to the Supreme Court, arguing that the New York monopoly was repugnant to the U.S. Constitution, specifically the Commerce Clause, and that his federal license granted him the right to navigate the waters despite the state law.
