The Sex Offender Registration and Notification Act (SORNA) of 2006 established detailed registration requirements for individuals convicted of sex offenses after its enactment. However, for the more than 500,000 individuals convicted before the Act (“pre-Act offenders”), Congress did not specify how the requirements would apply. Instead, 34 U.S.C. § 20913(d) provides: “The Attorney General shall have the authority to specify the applicability of the requirements of this subchapter to sex offenders convicted before the enactment of this chapter… and to prescribe rules for the registration of any such sex offender.” Pursuant to this authority, the Attorney General issued a rule making SORNA’s requirements applicable to all pre-Act offenders. Herman Gundy, a pre-Act offender, was prosecuted for failing to register under this rule. Gundy challenged his conviction, arguing that § 20913(d) constitutes an unconstitutional delegation of legislative power to the executive branch in violation of the separation of powers.
