The defendant, Dusch (lessor), leased property to the plaintiff, Hannan (lessee), for a fifteen-year term scheduled to begin on January 1, 1928. The lease agreement did not contain an express covenant requiring the lessor to deliver actual possession of the premises. When the lease term commenced, a tenant from a previous lease wrongfully held over and refused to vacate the property. Hannan was thereby prevented from taking possession. Hannan informed Dusch of the situation, but Dusch refused to take any legal action to oust the holdover tenant. Hannan sued Dusch for damages, alleging a breach of an implied covenant to deliver actual possession. The trial court sustained Dusch’s demurrer to the complaint, finding that the lessor had no such duty. Hannan appealed.
