Plaintiff Patricia Hilder rented a residential apartment from defendants Stuart and Patricia St. Peter. Upon moving in and throughout her fourteen-month tenancy, Hilder discovered and repeatedly notified the landlord of numerous severe defects. These included a broken window, a missing front door key, a perpetually clogged toilet, inoperable bathroom electrical fixtures, water leaks causing plaster to fall from the ceiling, and a pervasive odor of raw sewage from a broken pipe in the basement. The landlord consistently promised to make repairs but failed to do so. Hilder undertook some minor repairs at her own expense. Due to the falling plaster, she was forced to cease using one of the bedrooms. Despite these deplorable conditions, Hilder paid her rent in full for the entire tenancy.
