Jagdish Rai Chadha, a Kenyan-born East Indian holding a British passport, was lawfully admitted to the United States on a student visa. After his visa expired, the Immigration and Naturalization Service (INS) initiated deportation proceedings. An immigration judge, acting under authority delegated by the Attorney General pursuant to the Immigration and Nationality Act (INA), suspended Chadha’s deportation, finding he met the statutory requirements of continuous residence, good moral character, and extreme hardship. Section 244(c)(2) of the INA, however, authorized either house of Congress to pass a resolution to veto the Attorney General’s decision. The House of Representatives, without debate or a recorded vote, passed a resolution overturning the suspension of Chadha’s deportation. This resolution was not submitted to the Senate for its approval, nor was it presented to the President for his signature. Chadha challenged the constitutionality of the one-house legislative veto, arguing it violated the separation of powers. The INS agreed with Chadha’s position in court, but considered itself bound by the House’s action. The Court of Appeals found the veto unconstitutional.
