Plaintiff Johnson underwent hip surgery performed by Dr. Salinsky at Misericordia Community Hospital, during which his femoral artery and nerve were severed, leading to permanent paralysis. Dr. Salinsky had applied for staff privileges at Misericordia, misrepresenting his professional history and omitting information about malpractice insurance. His application stated his privileges had never been suspended or revoked, and listed consultant privileges at hospitals where he had no record. In reality, Dr. Salinsky had faced severe restrictions and denial of privileges at other Milwaukee hospitals due to concerns about his competence, including withdrawal of hip surgery privileges at Doctors Hospital and denial of any privileges at St. Anthony Hospital. Misericordia approved Dr. Salinsky’s application without a thorough investigation of his credentials, despite its own bylaws and Wisconsin Administrative Code provisions requiring a system for evaluating applicants based on character, competence, training, and experience. The hospital administrator approved the application, and Dr. Salinsky, shortly after admission, was elected chief of staff and endorsed his own privileges. The jury found Dr. Salinsky 20% negligent and Misericordia 80% negligent for its credentialing process, awarding significant damages.
